The taxman has the legal right to take this course of action without a court ruling, but a particular course of action needs to be acted according to to remain inside the law. Firstly, a letter will be sent to the taxpayer in arrears cautioning that distraint is about to begin. This may be followed by a visit to the debtor's home or premises by a tax representative, in order to determine what belongings and possessions that are worth something may be confiscated.
